1. General
These Terms govern the relationship between Marketorium (the “Provider”) and its clients (the “Client”) for marketing services offered through www.marketorium.bg. By using the site or requesting a service, you accept these Terms.
2. Services
Marketorium provides influencer marketing, PPC advertising (Google Ads, Meta Ads, TikTok Ads), marketing strategy, content production and consulting. Specific parameters are set out in an individual contract.
3. Contract
A contract is formed after an enquiry, an offer and written confirmation. Offers are valid for 30 days. Marketorium may decline an engagement without giving a reason.
4. Prices and payment
Prices are in euros (€) excluding VAT. One-off projects are paid 50% upfront and 50% on delivery. Monthly services are paid in advance. Ad spend and creator fees are agreed separately. Work may be paused if payment is more than 14 days late.
5. Timelines
Timelines are agreed individually and may be extended due to late materials from the Client, scope changes or force majeure. The Client agrees to provide materials and feedback on time.
6. Intellectual property
After full payment, rights to content created by Marketorium transfer to the Client within the agreed scope. Usage rights for creator content are agreed separately for each campaign. Marketorium may use the project as a reference.
7. Liability
Marketorium uses professional efforts to reach campaign goals but does not guarantee specific results (sales, reach, rankings), as these also depend on external factors. Marketorium is not liable for business interruption, third-party actions, or decisions and changes in the rules or algorithms of advertising platforms. Total liability is limited to the value of the service.
8. Confidentiality
Both parties keep business information confidential. Personal data is processed in accordance with our Privacy Policy.
9. Termination
Either party may terminate with 30 days’ written notice. Work actually performed is paid. Marketorium may terminate immediately if payment is more than 30 days late.
10. Governing law
These Terms are governed by Bulgarian law. Disputes fall under the jurisdiction of the courts in Sofia.
